1. Acceptance of Terms
By accessing or using Nivoryx Systems products, mobile application, or website ("Services"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our Services.
2. Products & Services
2.1 AquaSense Hardware
- AquaSense devices are sold as-is with a 1-year warranty
- Installation must follow provided guidelines
- Devices are designed for residential use in India
- Commercial use requires Business subscription
2.2 Mobile Application
- Free to download and use with basic features
- Some features require Pro or Business subscription
- Requires Android 7.0+ or iOS 13.0+
2.3 Subscription Plans
- Free: Basic monitoring, 7-day history, 2 devices
- Pro (₹99/month): Advanced features, 1-year history, 5 devices
- Business (₹299/month): Full features, unlimited history, 20 devices
3. User Accounts
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
- One account per person/household (Business accounts may have multiple users)
- We may suspend accounts that violate these terms
4. Payment & Billing
4.1 Pre-orders
- Pre-order deposit of ₹499 is required to reserve your AquaSense kit
- Deposit is fully refundable if you cancel before September 30, 2026
- Deposit will be adjusted against final payment upon delivery
- Balance payment due before shipping (expected Q3 2026)
- Pre-order terms are separate from regular purchase terms
4.2 Payment Methods
- All payments are processed securely through Razorpay
- We accept UPI, credit/debit cards, net banking, and digital wallets
- All prices are in Indian Rupees (₹) and include applicable GST
- International payments are not accepted at this time
- Razorpay payment gateway is PCI DSS compliant and secure
4.4 Razorpay Payment Terms
- Payments are processed by Razorpay, a third-party payment processor
- Your payment information is encrypted and secure
- We do not store your credit card or banking details
- Payment failures may occur due to bank issues or insufficient funds
- Successful payments are confirmed instantly via email
- For payment-related issues, contact our support team
4.3 Subscriptions
- Subscriptions are billed monthly or annually (with discount)
- You can cancel your subscription anytime from your account
- No refunds for partial months or unused subscription time
- Subscription starts after device delivery and setup
5. Pre-orders & Delivery
5.1 Pre-order Terms
- Pre-orders are for AquaSense kits expected to ship in Q3 2026
- ₹499 deposit reserves your position in the production queue
- You will be notified via email when production begins
- Deposit is refundable until September 30, 2026, or device shipment (whichever comes first)
- After shipment, refunds are processed according to our standard refund policy
5.2 Delivery & Shipping
- Free shipping within India for pre-orders
- Delivery typically takes 3-7 business days after shipment
- You will receive tracking information via email and SMS
- Risk of loss passes to you upon delivery to your shipping address
- Please verify the package contents at delivery
5.3 Refunds
- Pre-order deposits are refundable until September 30, 2026
- Refunds for any reason within 30 days of delivery (see Refund Policy)
- Refunds processed within 5-7 business days to original payment method
- Shipping costs are not refundable unless the product is defective
- Custom or personalized orders are not eligible for refunds
6. Warranty & Post-Warranty Support
6.1 Hardware Warranty
- 1-year warranty against manufacturing defects (18 months for pre-order customers)
- Does not cover damage from misuse, water damage, or electrical surges
- Warranty void if device is modified or opened
- Free repair or replacement during warranty period
- Free pickup and delivery for warranty claims within India
6.2 Post-Warranty Service
After warranty expires, we offer affordable repair and replacement services:
- Repairs: Diagnostic fee ₹200 (waived if repair approved), component replacement ₹300-1000, labor charges ₹500. Total typically ₹500-2000.
- Replacements: 30% discount on new device purchase. Subscription transfer included at no extra cost.
- Trade-In: Old device trade-in value ₹200-500 (based on condition).
- Service Request: Request service through app or website. Transparent quotes provided before work begins.
- Pickup & Delivery: Free pickup and delivery within India for service requests.
6.3 Subscription Transfer Policy
- When you replace a device, all active subscriptions automatically transfer to the new device
- Subscription transfer is included at no additional cost
- Device configuration and historical data are preserved during replacement
- Transfer happens instantly - no downtime, no need to contact support
- You can initiate device replacement through the app or website
6.4 Limitation of Liability
To the maximum extent permitted by law, Nivoryx Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Water damage from pump malfunction
- Loss of data or service interruption
- Damage from improper installation
Our total liability shall not exceed the amount paid by you for the product or service in the 12 months preceding the claim.
7. Acceptable Use
You agree not to:
- Reverse engineer or modify our devices or software
- Use our Services for any illegal purpose
- Attempt to gain unauthorized access to our systems
- Share your account credentials with others
- Resell our products without authorization
8. Intellectual Property
Nivoryx Systems, AquaSense, and related logos are trademarks of Nivoryx Systems. All content, software, and technology are protected by intellectual property laws. You may not use our trademarks without written permission.
9. Data Retention & Cloud Services
9.1 Data Retention Policy
- Free Tier: No cloud data storage. Device works offline only.
- Home Tier (₹99/month): 7 days of cloud history. Data deleted after 30 days of subscription cancellation.
- Pro Tier (₹199/month): 90 days of cloud history. Data deleted after 30 days of subscription cancellation.
- Ultimate Tier (₹499/month): Unlimited cloud history. Data retained as long as subscription is active.
9.2 Data Export & Ownership
- You can export your device data anytime in CSV or JSON format
- Data export is available in Device Settings → Export Data
- After subscription cancellation, you have 30 days to export your data before deletion
- You own your data - no lock-in, complete data ownership
- Historical data can be exported even after subscription ends (within 30-day grace period)
9.3 Cloud Service Terms
- Cloud services are optional enhancements - device works without them
- You can cancel cloud subscription anytime - device continues working offline
- Cloud data is stored securely on AWS infrastructure
- We reserve the right to modify cloud service features with 30 days notice
- Cloud service availability is not guaranteed - device works independently
10. Termination
- You may close your account at any time
- We may terminate accounts that violate these terms
- Upon termination, your cloud data will be deleted within 30 days (you can export before deletion)
- Hardware devices will continue to work offline (basic functions)
- Subscriptions can be cancelled anytime - device functionality is not affected
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Delhi, India.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or app notification. Continued use of our Services after changes constitutes acceptance of the new terms.
